Job Description:
The Executive Director of Contractor Compliance will be responsible for the development and implementation of the Union’s Heavy and Highway Fund compliance program, which targets non-union employers in an effort to level the playing field in the construction market. The program includes policies, education, training and establishing processes to smooth the way for an organizational culture of compliance. Representing the Heavy and Highway Fund for Local Union No. 3 and its signatory contractors, the ideal candidate will have previous industry experience with unions and will be comfortable being accountable to a governing board. Managing the day-to-day operations of the contractor compliance department, preparing annual budgets and providing monthly reports to the trustees, subcommittee and union membership are essential functions in this role. Guidance and oversight from the Executive Director of Contractor Compliance will be highly valued by internal stakeholders and affiliated entities. This guidance and oversight is expected and necessary to reinforce regulations in all aspects and levels of the construction industry, including but not limited to safety, prevailing wage, carb, licensing etc. This role requires high ethical standards along with diligence in completing goals that balance the objectives of the union and the fund. The guiding principles of the Executive Director of Contractor Compliance should always be to preserve and advance the union’s market share by making sure all contactors stay on a lawful and ethical course.

Minimum Requirements:

  • Must have 5 years of Contractor Compliance experience.
  • Must have a minimum of one (1) year of Management or Supervisory experience.
  • Must have 3 years of Public Policy experience.
  • High Level of experience and knowledge of Davis Bacon, CA prevailing wage and CA labor code preferred.
  • Must possess intermediate computer literacy skills (i.e. Intermediate typing speed, MS Office Suite).
  • Must possess a valid driver’s license.

Essential Functions:

  • Monitor construction projects to ensure compliance with prevailing wage requirements, and enforce such requirements through available avenues. 
  • Pursue opportunities to expand union market share through legislative and administrative advocacy, and compliance efforts, including submitting coverage determination requests and providing opinion letters to the Department of Industrial Relations in relation to pending coverage determinations.
  • Assess compliance-related educational needs and develop, implement, maintain and oversee training and education programs for compliance.
  • Oversee and monitor the compliance activities of field agents and other support staff.
  • Work cross-functionally with departments of Operating Engineers Local 3 to support compliance and organizing efforts.
  • Work cross-functionally with external stakeholders, affiliated entities and community partners to ensure alignment on key initiatives.
  • Work with stakeholders to develop a strategic plan for the Fund. This includes identifying measures and data points to track progress toward achieving the Fund’s objectives, and developing work plans to support those efforts.
  • Communicate compliance efforts and provide information updates on new laws, regulations and policy developments at the various governmental agencies and third party entities germane to construction compliance.

The Executive Director must be capable of performing job duties in high stress (crisis management) situations, during irregular and extended hours and be able to adapt to frequently changing laws, regulations, personnel and corporate philosophies. The duties of the Executive Director are generally performed under all types of working conditions in an independent manner often without support staff. The Executive Director must be able to work with others from all management levels. Flexibility and adaptability are of key importance. A highly motivated self-starter, the candidate is professional in both attitude, appearance and communications. This person must be dedicated, flexible and adaptable with a willingness to commit to continual learning. As a leader and decision maker, the Executive Director must demonstrate common sense, diplomacy and strong interpersonal skills. As a liaison, excellent communication skills (written and verbal) are required – including a level of literacy capable of reading and interpreting legal documents.

The Executive Director must also be prepared to travel, using various modes of transportation, including driving a vehicle, in all types of weather conditions, to urban, rural and remote locations, for varying durations. The Executive Director must believe in, and be loyal to the trade union movement.
