The Los Angeles Alliance for a New Economy (LAANE) has been in the forefront of the economic justice movement in L.A. since 1994. LAANE is known for its broad-based labor/community/environmental coalitions and its combination of organizing, research, communications, and policy development. LAANE led the movement to pass a Living Wage Ordinance in the city of L.A. in 1997 and continues to advocate for policies and programs that benefit the unemployed, low-wage workers, low-income communities, and the environment. Campaign Description: LAANE is currently seeking a full-time Misclassification Enforcement Fellow to support our campaign to win justice for workers in the port trucking industry at the Ports of Los Angeles and Long Beach. These are the largest ports in the country, responsible for nearly half of all U.S. containerized trade. This campaign seeks to achieve economic justice and put an end to wage theft for the 12,000 low-wage, mostly immigrant truck drivers at the Ports —most of whom are denied legal rights by being misclassified as “independent contractors.” Over the past five years, the campaign has made great strides in bringing the exploitation to light and bringing about change, in part through a concerted legal enforcement strategy, assisting drivers in reclaiming their rights as employees by bringing misclassification claims to government agencies and courts.
Position Responsibilities: The Misclassification Enforcement Fellow will advance the campaign’s legal enforcement work. Primary responsibilities will include legal representation of port drivers in misclassification cases, primarily wage theft claims with the California Division of Labor Standards Enforcement (DLSE), but will also include other administrative claims. May represent drivers in court to defend drivers’ rights to claims; examples include filing Anti-SLAPP claims against retaliatory suits or defending drivers against petitions to compel arbitration. Other responsibilities will include legal research, both to identify potential new legal strategies, and to stay up-to-date on any changes in laws affecting our work. The Misclassification Enforcement Fellow will also be an active member of the LAANE Ports team, and will support the work of the organization and the Ports team as a whole, and will also coordinate closely with worker organizers and the broader campaign team, within the context of an ongoing organizing campaign.
Qualifications: Applicants must demonstrate a commitment to economic justice and the labor movement. Applicant must be an attorney licensed with the California State Bar and have at least two years of experience in employment law. Additional skills required: written and verbal communications skills, interviewing skills, case management and organizational skills, ability to work well in a team. Also needed: willingness to work long hours and weekends when necessary, and ability to work independently. Driving your own car required. Strong preference for: experience within the labor movement or with a social justice organization, experience leading others, fluency in Spanish.
